Kentucky bills seek to ‘modernize’ cannabis laws, put recreational use to vote

Constitutional amendment would allow possession of small amounts

FRANKFORT, Ky. (FOX 56) — A Louisville Senator seeks to expand Kentucky’s cannabis legislation.

The first bill, Senate Bill 168, proposes a constitutional amendment that would allow voters to decide whether adults 21 and older could possess limited amounts of cannabis and cultivate a small number of plants for personal use.

“Decisions of this magnitude should not be made in isolation,” Senator Gary Clemons (D–Louisville) said. “Senate Bill 168 is about respecting Kentuckians enough to let them decide this issue for themselves.” Clemons said the bill would preserve the General Assembly’s authority to regulate cannabis production and sales if the amendment is approved.

The second measure, Senate Bill 164, would eliminate criminal penalties and arrests for low-level possession, prevent probation or parole violations based solely on cannabis possession, and establish a clear process for expunging eligible past cannabis convictions.
